Prodego’s Terms and Conditions

1. Acceptance of Terms

By creating a Prodego account, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the service.

2. Nature of Service; Not an Emergency Service

Prodego provides a platform for user-controlled safety alerts. PRODEGO IS NOT A REPLACEMENT FOR 911.

  • We do not provide professional monitoring or dispatch services.
  • In a life-threatening emergency, always contact local authorities first.
  • Delivery of alerts depends on third-party cellular networks and GPS satellites. Prodego is not responsible for delayed or failed notifications.

3. User Autonomy & Location Data

Prodego operates on an "SOS-only" philosophy.

  • Passive Safety (Timers): You are responsible for setting and canceling Activity Timers. If a timer expires, an alert will trigger automatically.
  • Active Safety (SOS): The manual SOS button triggers immediate alerts.
  • Safe Zones: You acknowledge that defining a "Safe Zone" may suppress alerts. You assume all risk for incidents occurring within these zones.

4. User Responsibilities

  • Contact Consent: You must obtain permission from individuals before designating them as Emergency Contacts.
  • Accuracy: You must provide accurate identity and contact information.
  • Age Requirement: Users under 18 must have verified parental consent per the Texas App Store Accountability Act.

5. Limitation of Liability

To the fullest extent permitted by law, Prodego (AEST Solutions / Apeece LLC) shall not be liable for any indirect, incidental, or consequential damages, including personal injury or death, resulting from your use of the app or the failure of any alert to reach its destination.

6. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes shall be resolved through binding arbitration in Dallas, Texas.
