1. Nature of Service (The "Not a 911 Replacement" Clause)
Prodego is a
peer-to-peer and automated notification tool, not a professional monitoring service or a substitute for local emergency services (911).
- No Guarantee of Response: Prodego does not guarantee that emergency contacts will receive, read, or respond to alerts.
- Connectivity: Notification delivery is dependent on cellular service and GPS accuracy; Prodego is not liable for failures due to network outages or hardware limitations.
2. Privacy-First Data Protocol
In alignment with our
User Autonomy Model, location data is handled with strict limitations:
- Passive vs. Active Tracking: We do not engage in 24/7 surveillance. Location data is only captured and transmitted when an Activity Timer expires without a check-in or when a manual SOS is triggered.
- Safe Zones: Users acknowledge that "Safe Zones" are user-defined and Prodego is not responsible for incidents occurring within these areas where alerts may be suppressed.
- Third-Party Disclosure: Data is shared only with designated emergency contacts and, where applicable, emergency responders during an active SOS event.
3. Compliance & Age VerificationTo comply with the
Texas App Store Accountability Act and federal regulations:
- Minors: Users under the age of 18 must provide verified parental consent before account activation.
- Identity Verification: Per telecommunications regulations (including Twilio/A2P 10DLC compliance), users must provide accurate identity and billing information to facilitate SMS/text alert functionality.
4. Limitation of Liability
To the maximum extent permitted by law,
Prodego LLC shall not be liable for any personal injury, property damage, or wrongful death resulting from:
- Failure of an emergency contact to act.
- User error in setting timers or designating contacts.
- The inherent latency of GPS or cellular technology.
5. Consent to Automated MessagingBy activating an account, users and their emergency contacts consent to receiving
automated text messages and push notifications. Standard message and data rates apply. Users are responsible for ensuring their emergency contacts have consented to being notified.
6. Termination of ServiceProdego reserves the right to suspend accounts that provide false identity information or misuse the SOS trigger for non-emergency purposes, which may incur costs to the platform and public responders.
